Terms of Service

The Skims Platform offers access to a range of digital services made available through both its website and mobile application. These services are designed to allow users to browse available products, complete purchases, and interact with various features intended to enhance the overall shopping experience. By accessing or using any part of the Platform, users confirm that they have read, understood, and agreed to be legally bound by the applicable terms and conditions. If a user does not accept any portion of these terms, they are required to discontinue use of the Platform immediately. Continued access or use of the services also indicates acknowledgment that any legal disputes must be addressed individually and cannot be brought forward as class actions or collective proceedings. The procedures governing dispute resolution are described within the full terms. The Company retains the right to modify, update, or revise these terms at its discretion, and continued use of the Platform following such changes constitutes acceptance of the revised conditions. In addition, the Company may, at any time and without prior notice, change, suspend, or discontinue any feature or portion of the Platform.

Through the Platform, users are able to engage in multiple activities including browsing and purchasing merchandise, creating and managing personal accounts, submitting reviews and ratings, joining waitlists for specific items, subscribing to promotional communications, participating in marketing campaigns or special offers, completing surveys, and using various tools intended to improve usability and customer experience. Some functions require the submission of personal information, which is processed in accordance with the Company’s Privacy Policy. The Platform is intended for use by individuals who are at least eighteen years of age, or by minors who are accessing the Platform under the supervision and consent of a parent or legal guardian. By using the Platform, each user confirms that they meet these eligibility requirements and are authorized to engage with the services provided.

Users are solely responsible for maintaining the confidentiality and security of their account credentials. Any activity conducted under a user’s account is deemed to have been authorized by that user, whether or not it was personally performed by them. Users are required to immediately notify the Company in the event of suspected unauthorized access, account compromise, or any security breach. All information provided during account creation, checkout, or other interactions with the Platform must be accurate, complete, and kept up to date. Users must not impersonate other individuals or provide misleading information regarding their identity under any circumstances.

All product-related details, including descriptions, pricing, promotional offers, and availability, are subject to change without prior notice. An order placed through the Platform represents an offer to purchase, and it is only considered accepted once payment has been successfully processed and confirmed by the Company. The Company reserves the right to refuse, cancel, or limit any order at its discretion, including but not limited to situations involving stock shortages, pricing errors, system malfunctions, or suspected fraudulent activity. Delivery estimates provided at the time of purchase are for general reference only and are not guaranteed, as shipping delays may occur due to carrier operations or external factors beyond the Company’s control. Once an order has been handed over to a shipping carrier, responsibility for the shipment is transferred to the customer, including any risk of loss or damage during transit.

Returns, exchanges, and related procedures are governed by the Company’s Return Policy, which is incorporated into these terms by reference. All content displayed on the Platform, including written material, visual elements, logos, graphics, images, and software components, is protected under applicable intellectual property laws and remains the property of Skims Body, Inc. or its respective licensors. Users are prohibited from copying, reproducing, distributing, modifying, or creating derivative works based on any Platform content without explicit written permission. Users also agree not to interfere with or disrupt the Platform’s functionality, attempt unauthorized access to systems or data, introduce malicious software, or engage in any behavior that may compromise the security or integrity of the services.

Any dispute arising out of or relating to the use of the Platform or these terms shall be resolved through binding individual arbitration, and users expressly waive the right to participate in class actions or representative legal proceedings. To the fullest extent permitted by applicable law, the Company’s liability is limited to the amount paid by the user for the relevant product or service, and the Company shall not be held responsible for indirect, incidental, special, or consequential damages. Personal data collected through the Platform is handled in accordance with the Privacy Policy.

The Company reserves the right to suspend or terminate user access to the Platform at its sole discretion if there is a violation of these terms. These terms are governed by the laws of the State of California, except where arbitration provisions apply. Together with the Privacy Policy and any other referenced policies, these terms constitute the entire agreement between the user and Skims Body, Inc. regarding use of the Platform and supersede any prior agreements, communications, or understandings.
